TERMS AND CONDITIONS

1. Scope of Application

(1) These General Terms and Conditions (hereinafter: GTC) apply to all contracts concluded through our online shop between us,

and you as our customer. The GTC apply regardless of whether you are a consumer, entrepreneur, or merchant.

(2) All agreements between you and us in connection with the purchase contract arise specifically from these terms of sale, our written order confirmation, and our acceptance.

(3) The version of the GTC valid at the time of contract conclusion is binding.

(4) We do not accept any deviating conditions from the customer. This also applies if we do not expressly object to their inclusion.

2. Conclusion of Contract

(1) The subject matter of the contract is the sale of goods. The presentation and promotion of items in our online shop do not constitute a binding offer to conclude a purchase contract.

(2) By submitting an order via our online shop by clicking the “order with payment” button, you place a legally binding order. You are bound to the order for a period of two (2) weeks after placing it; your statutory right of withdrawal remains unaffected.

(3) We will promptly confirm receipt of your order by email. Such confirmation does not constitute a binding acceptance of the order unless acceptance is expressly declared therein.

(4) A contract is only concluded when we accept your order through an express declaration of acceptance or by delivering the ordered items.

(5) Orders for deliveries outside of Germany may be subject to a minimum order value. You can find the minimum order value in the pricing information provided in our online shop.

(6) If delivery of the ordered goods is not possible (e.g., because the goods are not in stock), we will refrain from sending an acceptance declaration. In such cases, a contract is not concluded. We will inform you without delay and refund any payments already made.

3. Delivery Conditions and Reservation of Prepayment

(1) Partial deliveries may be made if reasonable for you.

(2) The delivery period is approximately five (5) working days within Germany, around ten (10) working days within Europe and Switzerland, and around thirty (30) working days for all other countries, unless otherwise agreed. The delivery period begins—subject to paragraph 3—upon contract conclusion.

(3) For orders from customers residing abroad or if there are justified indications of payment default risk, we reserve the right to deliver only after receipt of full payment including shipping costs (prepayment reservation). If we invoke this reservation, we will inform you without delay. In this case, the delivery period begins upon payment.

4. Prices and Shipping Costs

(1) All prices shown in our online shop are gross prices including statutory VAT and exclude any applicable shipping costs.

(2) Shipping costs are listed in our pricing information. The total price including VAT and shipping costs will be displayed in the order overview before you place your order.

(3) If partial deliveries are made by us, you will only be charged shipping costs for the first delivery. If partial deliveries are made at your request, shipping costs will be charged for each partial delivery.

(4) If you exercise your right of withdrawal, you may demand reimbursement of outbound shipping costs according to statutory requirements.

5. Payment Conditions and Offsetting and Withholding Rights

(1) The purchase price and shipping costs are due within two (2) weeks after receipt of our invoice.

(2) Payments may only be made using the payment methods offered in our online shop.

(3) You may only set off claims against us if your counterclaims are legally established or undisputed. You may also set off if you assert claims for defects or counterclaims arising from the same purchase contract.

(4) You may only exercise a right of retention if your counterclaim arises from the same purchase contract.

6. Retention of Title

Goods delivered remain our property until full payment of the purchase price has been received.

7. Warranty

(1) We are liable for defects in quality or title of delivered items in accordance with statutory provisions, particularly §§ 434 ff. BGB. The statutory limitation period for defect claims is two (2) years from delivery of the goods.

(2) Any seller guarantees or manufacturer warranties granted in addition to statutory rights apply according to their respective terms. Details can be found in the warranty information accompanying the goods, where applicable.

8. Liability

(1) We are liable for intent and gross negligence according to statutory provisions.

(2) In all other cases—unless otherwise provided in paragraph 3—we are liable only for breaches of essential contractual obligations (cardinal obligations). Liability in such cases is limited to foreseeable, typical damages.

(3) Liability for injury to life, body, or health, and liability under the Product Liability Act, remains unaffected.

9. Copyright

All images, films, and texts published in our online shop are protected by copyright. Usage without our express permission is prohibited.

10. Dispute Resolution, Applicable Law, and Jurisdiction

(1) We do not participate in consumer arbitration procedures before a dispute resolution body, nor are we obliged to do so.

(2) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you placed your order as a consumer and your habitual residence at that time is in another country, mandatory legal provisions of that country remain unaffected.

(3) If you are a merchant and your registered office is in Germany at the time of ordering, exclusive place of jurisdiction is the registered office of the seller. In all other cases, statutory provisions regarding jurisdiction apply.
